GENERAL TERMS AND CONDITIONS OF SALE – NOMADIC STATE OF MIND

Preamble

The website www.nomadicstateofmind.fr is the property of the company CREATIVE COTTON in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, hypertext links to the site are authorized without specific requests.

1. Acceptance of the conditions

The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between CREATIVE COTTON and its customer, both parties accepting them without reservation. These general conditions of sale will prevail over any other conditions appearing in any other document, unless prior, express and written waiver.

2. Products

The photographs illustrating the products are not contractually binding. If errors appear in them, CREATIVE COTTON cannot be held liable under any circumstances. The majority of products offered to its customers by CREATIVE COTTON are available in our warehouse.

3. Order

Automatic recording systems are considered proof of the nature, content and date of the order. CREATIVE COTTON confirms acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded upon confirmation of the order. CREATIVE COTTON reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information provided by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient's contact details, the seller cannot be held responsible for any inability to deliver the product.

4. Delivery

After order confirmation, CREATIVE COTTON undertakes to deliver to its carrier all the references ordered by the buyer within a maximum of 96 hours, or 4 working days. The carrier undertakes by contract with CREATIVE COTTON to deliver the order to the buyer's address provided by CREATIVE COTTON.
In addition, for deliveries outside mainland France and the European Union, the customer agrees to pay all taxes due on the importation of products, customs duties, value added tax (VAT), and all other taxes due under the laws of the country where the order is received.

All orders placed with CREATIVE COTTON are for the personal use of customers. Customers or recipients of the products are prohibited from any partial or total resale of the products. CREATIVE COTTON is therefore released from any legal liability if the payment of taxes is not made by the customer.
Delivery will be carried out by the logistician via COLISSIMO or MONDIAL RELAY (Relay Point Delivery only, free under certain conditions*) depending on the choice and the address provided by the customer.

MONDIAL RELAY = DELIVERY to a relay point and not to your home (free delivery under conditions*: only to a relay point and not to your home).

Any cancellation of an order shipped via Mondial Relay that is not collected and for which the customer requests a refund will result in a €5 delivery charge being deducted from the refund. Any package not collected from the relay point will be charged €5 to the customer in the event of a refund request.

Delivery by MONDIAL RELAY:

Delivery to a collection point only. If the customer does not select a collection point, the logistics team will select the collection point closest to the customer's home. However, if the customer does not collect their package within the 8-day return period, the customer will be charged 5 euros for this shipment.

Free delivery (under certain conditions*) is a goodwill gesture that CREATIVE COTTON offers its customers when they make a purchase. In the event of a return with a refund request, €4 will be deducted from the refund amount. In the event of a return for exchange, the return shipping costs are the responsibility of the customer, and the reshipping costs are again covered by CREATIVE COTTON as a goodwill gesture. However, if: following the second shipment there is a return with a refund request, €8 will be deducted from the refund amount.

COLISSIMO: In the event of a package being returned by the carrier for the reason: “Recipient address not found”, if after research the address error is due to an input error by the customer during purchase (missing street number, incorrect postal code, incorrect name, etc.), the ex-postal costsThe shipping company will be billed again for reshipping the order to the corrected address.

FREE DELIVERY from 100 euros free delivery under conditions*: Delivery only to relay points and not to your home!

In case of return with refund request 4€ will be charged for the shipping of the order, this service offered by the company CREATIVE COTTON for its customers, is only valid for an order finalized and accepted in its entirety by the buyer.

In the case of a multi-product order, if pairs are returned with a refund request, in the event that the amount of the order kept no longer reaches €100, then €4 will be charged and therefore automatically deducted from the refund amount.

FOR SHIPPING BY COLLISSIMO
*In case of an input error during your purchase, or failure to collect your package, you will be charged €7 for France, and €10 or €11 for Europe (price varies depending on destination) for reshipping to the new address, or will be deducted in the event of a refund request.

Any delays do not entitle the buyer to claim damages.
In the case of a technical product, the customer will take particular care to check that the device delivered is working properly and to read the instructions provided.
In the event of apparent defects, the buyer has the right to return the goods under the conditions set out in this document. War, riots, fire, strikes, accidents, and the impossibility of obtaining supplies are considered cases of force majeure, releasing the seller from his obligation to deliver. Goods always travel at the recipient's risk. Always check your package upon arrival. You have 48 hours to make any reservations with the carrier in the event of missing or damaged items.
Due to availability, an order may be delivered to the customer in multiple installments. The customer then pays for only one delivery. If the customer requests delivery to two locations, they place two orders, each with the associated delivery costs.

5. Withdrawal

FOR ANY SIZE EXCHANGE / RETURN OF SANDALS
14 DAY RIGHT OF WITHDRAWAL! After receiving the package. All returns of sandals must be made within this period! After this period, exchanges and refunds are no longer accepted. Thank you for your understanding.

WE ONLY EXCHANGE AND REFUND SANDALS IN NEW CONDITION!!

Any sandals that have already been worn, on dirty or rough surfaces, and have suffered signs of wear or traces of dirt, will not be exchanged or refunded!

The sole cord marks easily and loses its shine. Therefore, we will not be able to replace the sandals for sale as a new product.

ATTENTION! "OUTLET PRODUCTS" OR "EXCEPTIONAL DISCOUNT" PERIODS ARE ONLY EXCHANGEABLE BUT NOT REFUNDABLE!

" OUTLET" products are only exchangeable (size or model) but not refundable, if the new desired product is more expensive a credit card payment link will be sent to you, in the case where the new product is cheaper, the customer agrees to lose the difference. In the case of an exchange with a product not in the " OUTLET" section, the conditions of sale and withdrawal of the initial " OUTLET " order take precedence over the entire order. Clearly, if you decide to exchange your " OUTLET" item for a product not in the " OUTLET " section in the event of a return with a refund request, you will only be refunded the price difference between the two models. The amount of the initial order is not refundable, therefore the customer waives part of their refund.

IMPORTANT INFORMATION:

Unfortunately, following BREXIT , RETURNS and EXCHANGES are no longer accepted FREE OF CHARGE, given that import charges (taxes) are applicable in both directions, both upon delivery (receipt by the recipient customer) and in the event of RETURN or EXCHANGE (to our warehouses).

However, if you wish to exchange or refund your purchase, please note that 23% of the amount of your order will be charged in the event of an exchange, or will be deducted directly from the amount of your refund.

5.1 Return costs in the event of withdrawal

Return costs are the responsibility of the customer!

In case of exchange, the return shipping costs will be our responsibility. We will share the costs with you.

Please return the sandals with a “tracking number” by attaching an explanatory note of your wish (exchange or refund) including Name and Order Number.

The online buyer, like any mail-order consumer, has a 14-day right of withdrawal from the day after they take possession of the goods or accept the offer for a service, without justification or payment of penalties on their part. However, they may be liable for return shipping costs. This right of withdrawal also applies to sale, second-hand, or clearance products.

The refund of the order must be made within 14 days from the moment the professional is informed of the customer's decision to withdraw.

5.2 Reimbursement in the event of withdrawal following Mondial Relay and PAYPAL fees

1_Mondial Relay: In the event of a return by the customer, with a refund request for any order delivered by Mondial Relay (free delivery to a relay point under certain conditions*), €4 will be retained from the refund amount.
2_PAYPAL: For all orders paid via Paypal, in the case of a return with a refund request, the Paypal fee equivalent to 3.5% of the total order amount will also be deducted from the refund.

IMPORTANT: REQUEST FOR REFUND IN THE EVENT OF OPENING A DISPUTE BY THE BUYER FOR NON-RECEIPT OF GOODS OR ERRONEOUS GOODS

If the customer requests a refund for non-receipt of the package, while the goods have already been shipped by the company CREATIVE COTTON and the carrier in charge of the order confirms its delivery to us, the company CREATIVE COTTON will then not proceed with the refund of the order, but with a second shipment of the latter.

However, if the customer, despite the second delivery, wishes to return the pair(s) received during this second shipment made by the company CREATIVE COTTON, and requests a full refund of their order, the company CREATIVE COTTON may then open an investigation with its logistician and the carrier.

If the evidence gathered can be considered serious, in the eyes of the company CREATIVE COTTON, the latter may classify it as a Risky Order and refuse the refund request or grant a partial refund.

5.3 Reimbursement following a dispute

Following the increase in online shopping fraud by malicious people.

Who buy discounted products on other sites and then make companies believe that they received incorrect products. If the customer requests a refund for delivery of the wrong product or size, CREATIVE COTTON will repatriate the pair shipped and received by the customer, as well as reship the pair originally ordered at its expense, but unfortunately will not refundorder processing.

5.4 Special conditions

Provided that this is clearly indicated at the time of purchase, certain so-called “special” products or services are not subject to the right of withdrawal and cannot be refunded:

  • well made especially for the consumer (custom-made for example);
  • product which cannot by nature be returned;

In the event of an exchange, except in the event of an error by CREATIVE COTTON, the return and reshipping costs are the responsibility of the customer for all orders.
France
In the event of exercising the right of withdrawal, CREATIVE COTTON is required to reimburse the sums paid by the customer, free of charge, with the exception of shipping and return costs. The refund is due within a maximum period of 15 days.

6. Price

The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs, transport and commissioning costs.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by CREATIVE COTTON. The price of the products is payable in cash on the day the order is actually placed. Payment is made by credit card or PayPal. Online, PayPal allows you to pay via a PayPal banking server in a secure environment.
Your credit card number is therefore directed to PAYPAL servers, your payment is made directly to a bank in a secure environment without going through the store server, a guarantee that is all the more important since your numbers are known only to our banking partner PAYPAL. The order validated by the customer will only be considered effective when the relevant banking payment centers have given their approval. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, CREATIVE COTTON reserves the right to refuse any order from a customer with whom there is a dispute.

8. Disputes

This contract is subject to French law. CREATIVE COTTON cannot be held liable for damages of any kind, whether material, immaterial or physical, which may result from malfunction or misuse of the products sold. The same applies to any modifications to the products resulting from the manufacturers. The liability of CREATIVE COTTON will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association in the sector, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.
Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution.
Failing this, the Commercial Court of AIX EN PROVENCE shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

9. Warranty

In all cases, CREATIVE COTTON cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. CREATIVE COTTON's liability is systematically limited to the value of the product in question, valueits date of sale and this without any possibility of recourse against the brand or the company producing the product.
In any event, the customer benefits from the legal guarantee of eviction and hidden defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the hidden defect, the seller must legally repair all the consequences (Art. 1641 et seq. of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (Art. 1648 of the Civil Code). 10. Legal information

The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, preparing invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act, the processing of personal information relating to customers has been declared to the French National Commission for Information Technology and Civil Liberties (CNIL). The customer has (Article 34 of the Act of 6 January 1978) a right of access, modification, rectification and deletion of data concerning them, which they may exercise with CREATIVE COTTON. Furthermore, CREATIVE COTTON undertakes not to communicate, free of charge or with compensation, the contact details of its customers to a third party.
